(EXCLUDING, WITHOUT LIMITATION, PUERTO RICO AND OTHER US TERRITORIES) ONLY AND SHALL ONLY BE CONSTRUED AND EVALUATED ACCORDING TO UNITED STATES LAW AND AMERICAN ENGLISH. YOU MUST BE THE AGE OF MAJORITY IN YOUR STATE OF RESIDENCE OR OLDER AND NOT OVER 26 YEARS OF AGE TO ENTER. YOU ARE NOT AUTHORIZED TO ENTER THIS CONTEST IF YOU DO NOT MEET THESE CRITERIA.
STA Travel’s “"Show us your beaches, Beaches!"” Contest (the “Contest”) Official Rules
No Purchase Necessary. A purchase will not increase your chances of winning the prize.
1. The “Contest Period” is from Midnight Central Time (“CT”), May 1, 2008 ("Contest-Start") to 5:00 pm, CT, May 31, 2008 ("Contest-End"). Sponsor’s clock governs time.
2. Eligibility: This Contest is open only to legal residents residing in the 48 contiguous United States and D.C. who are the age of majority in their state of residence, are not over the age of 26. Void in Puerto Rico, other US territories or where prohibited, licensed, restricted or taxed. Employees, officers, directors, agents, representatives and their immediate families (spouse, parents, children, siblings and each of their spouses regardless of where they live) or members of household of STA Travel, Inc. (“Sponsor”), Air Pacific and THE MARKETING AGENCY, LLC and their respective parent companies, subsidiaries, advertising, design, web design, web hosting and promotion and publicity agencies and anyone connected with the production or distribution of this Contest (“Contest Entities”) are not eligible to enter or be awarded a prize. All entries must be made by an individual from a stand-alone computer and may not be made by proxy or any electronic/automated means such as script, bot, macro or any other similar software or program. All discovered entries made in violation of these rules will be deleted.
3. How to Enter: This Game is played only on the Internet. Go to www.statravelers.com/fiji and click on “Enter Now.” Log in or create a free profile. Enter all the required information including full name, email address, ZIP code and a valid email address for which you are the authorized user and upload a photo that best expresses a fantastic and unique day at the beach (see #5 below – Voting and Winner Selection). The Grand Prize winner will be notified by email only, so it is an entrant’s responsibility to keep his/her email address current. Maximum one (1) entry per person or email address during the Contest Period. “Authorized user” is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider or organization (e.g. business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the email address. In the case of a dispute regarding who submitted a particular online entry, the entry will be deemed submitted by the authorized account holder of the email account. Entries must: (i) be original; (ii) be created solely by entrant; (iii) not have been previously published, submitted in other Contests or won previous awards; and, (iv) not infringe on the rights of any third party. Photos must not contain pornography, lewd or inappropriate activities, sexual or racial slurs or connotations, representations of any brand name or logo, offensive language or any material that would be offensive to a group or to an individual. Sponsor reserves the right not to consider any photo it deems unacceptable in its sole determination and will not engage in any form of communication or discussion with anyone who submits a photo.
4. Essay and Photo Rights: By entering this Contest, you are certifying that you meet the eligibility requirements as set forth in these Official Rules. By entering this Contest, you explicitly agree to: (i) grant to the Sponsor the right to use and publish the biographical information that you provide (except street address, telephone number and e-mail address) and the submitted essay and photo in all media, including, but not limited to, online displays, television, cable, photo productions, wireless applications and other media channels and applications and for advertising, promotions, other Contests sponsored by the Sponsor and other purposes without further consent or compensation, unless otherwise prohibited by law, and you do further irrevocably assign and transfer to Sponsor any and all rights, title and interest in the entry, including, without limitation, all copyrights and moral rights in the photo, and grant Sponsor the right to modify, adapt, sell, publish, use or not use the entry in any way, in whole or in part, in any and all media now known or later developed, without time or territorial limitations or compensation, except where prohibited by law; (ii) agree that the Sponsor, or those acting on its behalf, may photograph and film you and use such photographs and film for all advertising, promotional, trade and other purposes and in all media, including, but not limited to, newspapers, magazines, online displays, television, cable, photo productions, online access, wireless applications and other media channels and applications without further consent or compensation, except where prohibited by law; (iii) represent and warrant that you have the right to grant to Sponsor the rights in the submitted essay and photo provided above; (iv) certify that you are not affiliated with commercial talent unions; and (v) represent and warrant that you have not used licensed material or any material owned by someone other than you in your essay or photo; and (vi) represent and warrant that your essay and photo is original and you have not copied or plagiarized the concept for your easy or photo from other material. In addition, you explicitly warrant that the images and likenesses used in your photo are of people who have consented to be photographed and for the photo to be submitted into this Contest.
5. Voting and Winner Selection: The judges will consist of a selection of senior marketing staff members of Sponsor. In scoring, the judges will consider: 1) the uniqueness of the beach scene photo (35%); 2) the composition of the photo; (30%); 3) the technical qualities of the photo (20%); and 4) the overall expression of “the perfect beach experience” (15%).
6. Quantity, Prize, Approximate Retail Value (ARV) and Odds: (1) Grand Prize: Two (2) Round-trip tickets from/to Los Angeles to Fiji courtesy of Air Pacific and round-trip airfare from/to the nearest major airport to winner’s residence in the 48 contiguous United States to/from Los Angeles, excluding taxes, fees and surcharges. The flights may have stops and/or plane/airline changes. Travel must be booked through STA Travel by December 31, 2008 and at least 45 days prior to earliest desired travel date and must be completed by June 30, 2009. Blackout travel dates are as follows: July, August, and December 14, 2008-January 15, 2009. Winner will be responsible for all other expenditures not specifically included in the trip, including, without limitation, meals, beverages, gratuities, telephone, excursions/activities, incidentals, transportation to and from originating and destination airports, personal expenses and travel/medical/baggage insurance. Travel is subject to blackout dates and space availability. Winner will asked to select three departure dates, in order of preference, and Sponsor will assign travel dates. The trip is awarded “as is.” Winner acknowledges that Contest Entities have neither made, nor are in any manner responsible or liable for, any warranty, representation or guarantee, expressed or implied, in fact or in law, relative to the prize or regarding the use, value or enjoyment of the prize. ARV: - $3,000 as of Contest-Start date. The Grand Prize will be awarded if properly claimed according to the Official Rules. Should the cost of the prize be less than the ARV the difference will not be awarded.
7. General: Contest judging will handled by Sponsor and contest administration and winner verification will be supervised by THE MARKETING AGENCY, LLC, an independent judging organization whose decisions are final and legally binding. No participant or winner shall have the right to contest any decision by Sponsor or the independent judging organization concerning any aspect of the Contest or the interpretation of the Official Rules or the determination as to the qualification or quality of entries. By participating in this Contest, you agree to be bound by these Official Rules. Sponsor is not responsible for those who cannot access the Internet or cannot click-through for any period of time regardless of technical, hardware, software, telephone, Internet, virus contamination or network problems, or for delay, failure or malfunction for any reason including, but not limited to, lost or unavailable network connections, failed, incomplete or garbled computer or telephone transmissions, typographical or system errors, human errors including, but not limited to, errors by Sponsor’s representatives who enter incorrect information into any of Sponsor’s computer systems or by force majeure. Proof of entry is not proof of entry receipt. Sponsor reserves the right to terminate the Contest if in Sponsor’s sole determination it believes that the integrity of the Contest has been, or could be, compromised or that the Contest is not capable of running as planned. One (1) winner will be chosen from eligible entries awarded and received up to the time of cancellation. Sponsor reserves the right to disqualify any entry from the Contest if in Sponsor’s sole judgment entrant has not complied with these Official Rules. Without limitation, all of an entrant’s entries will be disqualified, at the sole discretion of Sponsor, if entrant attempts (i) to enter the Contest through any means other than as described in these Official Rules; or (ii) provides information that is inaccurate or fraudulent; or (iii) attempts to disrupt the Contest or circumvent the terms and conditions of these Official Rules. Only the prize listed and the value listed in the Official Rules shall be awarded. Winner and travel companion (who must also be the age of majority in his/her state of residence or older and under the age of 26) must not consume alcoholic beverages unless they are 21 years of age or older. Grand Prize winner and travel companion must travel all legs of all flights and all segments of the trip together. It is the Grand Prize winner’s and winner’s travel companion’s responsibilities to learn the rules and regulations for entering and staying in the destination countries. Grand Prize winner and travel companion are responsible for: 1) all travel documents including, without limitation, a current, valid U.S. Passport, visas where required for each country visited or other travel document requirements acceptable to the airlines, The Transportation Security Administration, the tour operator, all venues and the destination Governments, (2) all medical requirements, (3) respecting all local regulations; and (4) for full compliance with the regulations of the countries and venues. Sponsor, airline(s), customs, immigration and local authorities have the right to refuse travel and/or admission to anyone who does not have proper travel documents or who does not comply with all regulations or comport him/herself properly. There will be no substitution or compensation for a prize or part of a prize forfeited due to winner's or winner's companion's non-compliance with airlines’ or any other reason. The Grand Prize winner and his/her companion will be required to execute and return an Affidavit of Eligibility, Liability and Publicity Release and Affidavit of Eligibility, Liability and Publicity Release (Travel Companion) respectively within two (2) business days of date on notification or it will be concluded definitively that the prize has been declined and, without further notice, an alternative winner may be selected in random drawings. If either Grand Prize winner or Travel Companion is less than 21 years of age, the appropriate Affidavit of Eligibility, Liability and Publicity Release may have to be signed by a parent or legal guardian. By entering this Contest, a participant explicitly releases, discharges and holds harmless the Contest Entities, and their employees officers and directors, one and all, from any and all liability, actions, causes of action, damages, actual, incidental or consequential, claims and demands whatsoever in law or equity, including all “costs”, which he/she now has or may acquire, by reason of any personal injury, death, loss of or damage to property, or any reason, occurring during or arising out of his/her participation in the Contest and the acceptance and use or misuse of a prize and for any claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trademark infringement or any other intellectual property related cause of action. Prizewinner waives the right to 1) assert as a cost of winning the prize any and all costs of verification and redemption or travel to redeem said prize, and 2) claim any liability (including attorney's fees and costs) which might arise from redeeming or seeking to redeem said prize. The right to receive the prize is non-assignable and non-transferable and no prize substitution, transfer, exchange or cash equivalent will be allowed except by Sponsor who reserves the right to substitute a prize (or portion of prize) of equal or greater value in case of unavailability of the prize or force majeure. Prize or prize notification that is returned as undeliverable will disqualify the winner and an alternative winner may be selected in a random drawing.
8. All federal, state and local laws and regulations apply. If any provision of this Contest shall be deemed to violate any federal, state or municipal law, it shall be amended to conform to such law and all other provisions shall remain in full force and effect.
9. All taxes are winner’s responsibility and a 2008 form #1099 will be issued to Grand Prize winner in the amount of $3,000 or the value of the prize.
10. Acceptance of the prize constitutes permission to use the winner's name, voice and likeness and any and all identifying characteristics including, but not limited to, the taking of photographs and/or photos by Sponsor's photographer/photographer for publicity purposes, without further consent or compensation, unless prohibited by law and winner agrees to execute any and all documents requested by Sponsor to convey such rights to own all the results thereof. Nothing contained herein shall be deemed to obligate Sponsor to make use of any of the rights granted herein and winner waives any right to inspect or approve any such use of any and every nature and kind.
11. The Contest Entities are not responsible for technical, pictorial, typographical or editorial errors or omissions in any marketing materials or these Official Rules.
12. All entries submitted become the property of Sponsor and none will be returned or acknowledged. Sponsor and The Marketing Agency will collect personal information from you when you enter the Contest. The information collected is subject to Sponsor's Privacy Policy found by clicking “Privacy Policy” at http://www.statravel.com/privacypolicy.htm and The Marketing Agency’s Privacy Policy found by clicking “Privacy Policy” at http://themarketingagency.com/html/sweepstakes.html.
13. As a condition of participating in this Contest, you agree that any and all disputes which cannot be resolved between the parties, claims and causes of action arising out of or connected with this Contest, or any prizes awarded, or the determination of the Winner shall be resolved individually, without resort to any form of class action exclusively by arbitration pursuant to the commercial arbitration rules of the American Arbitration Association, then effective. Further, in any such dispute, under no circumstances will you be permitted to obtain awards for, and you hereby waive all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys' fees, other than your actual out-of-pocket expenses (i.e., costs associated with entering this Contest), and you further waive all rights to have damages multiplied or increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or your rights and obligations or STA Travel's rights and obligations in connection with this Contest, shall be governed by, and construed in accordance with, the laws of the State of Texas, U.S.A., without giving effect to the conflict of laws rules thereof, and all proceedings shall take place in that State in the City of Dallas.
